By downloading, accessing, or using Tumire, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the app. Your continued use of Tumire confirms your acceptance of this agreement and any updates made to it from time to time.
Tumire is a lightweight plant care assistant designed to help everyday flower and plant owners review visible plant conditions, receive general care suggestions, create reminders, and keep simple local records. The app allows users to submit one plant image at a time through the camera or photo library, optionally add short notes and care context such as plant type, watering timing, indoor or outdoor setting, and sunlight level, and then request an automated Plant Care Check.
The service may generate outputs such as a plant status label, confidence hints, possible reasons for visible issues, suggested same-day care steps, short-term observation advice, and reminder suggestions. Tumire may also allow users to save care cards, view up to the most recent 50 local history records, add lightweight action tags, copy advice text, and schedule or manage local reminders. Tumire is intended as a practical support tool for plant observation and organization, not as a professional horticultural, scientific, botanical, pest-control, or disease-diagnosis service.
The app does not promise identification of every plant species, does not provide open-ended chat services, does not operate as a social platform, and does not guarantee recovery or treatment outcomes for any plant. Certain features may require device permissions, network access, Apple services, or local device functionality to work properly.
We may suspend, restrict, or terminate your access to Tumire at any time, with or without notice, if we believe you have violated these Terms, created risk or liability, misused the service, interfered with app operations, or used the app in an unlawful manner. We may also discontinue the app or any feature at our discretion.
You may stop using Tumire at any time. Termination or discontinuation of access does not affect any rights or obligations that by their nature should survive, including provisions relating to intellectual property, disclaimers, liability limitations, and indemnification.
Subject to your compliance with these Terms, you are granted a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use Tumire for lawful, personal, non-commercial purposes. This license only permits use of the app as made available to you and does not transfer any ownership rights.
You may not use Tumire for commercial exploitation, resale, service bureau activity, competitive analysis through unauthorized means, or any purpose inconsistent with these Terms.
You retain ownership of the content you provide to Tumire, including plant photos, notes, tags, and care-related inputs. By using the app, you grant a limited license necessary for the app to process that content for the purpose of generating care-related outputs, displaying your records, creating thumbnails, and supporting reminder and history functions.
This license is non-exclusive and limited to operation of the service. Tumire does not claim ownership of your content. You represent that you have the rights and permissions needed to submit any content you provide and that your content does not violate law or the rights of any third party.
To the maximum extent permitted by applicable law, Tumire and its owners, operators, licensors, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, business opportunity, device functionality, or plant-related loss arising out of or related to your use of, or inability to use, the app.
This limitation applies whether a claim is based on contract, tort, negligence, strict liability, statute, or any other legal theory, even if advised of the possibility of such damages. If liability cannot be fully excluded under applicable law, it will be limited to the minimum extent permitted by law.
Tumire provides automated observations and plant care suggestions based on visible image details and user-supplied context. All generated results are provided for general informational and organizational purposes only. Outputs may be incomplete, inaccurate, overly general, delayed, inconsistent, or unsuitable for a particular plant, environment, season, or condition.
The app does not provide professional horticultural advice, disease diagnosis, pest treatment instructions, chemical treatment recommendations, emergency guidance, or guaranteed plant recovery outcomes. You are solely responsible for deciding whether and how to act on any result. Any reliance on generated outputs is at your own risk. You should observe your plant carefully and seek professional assistance when needed, especially for severe wilting, visible infestation, mold, rot, or persistent decline.
You agree not to misuse Tumire. Prohibited conduct includes, without limitation: using the app for any unlawful, fraudulent, abusive, or deceptive purpose; attempting to reverse engineer, decompile, disassemble, or extract source code except where expressly permitted by law; interfering with app security or functionality; introducing malware, harmful code, or disruptive material; using bots, scripts, scraping tools, or automated methods to access or abuse the service; circumventing payment mechanisms, free-use limits, or device-based restrictions; submitting content you do not have rights to use; and infringing the intellectual property, privacy, or other rights of any person or entity.
You also may not use Tumire in a way that overloads, damages, disables, or compromises the app, related systems, or third-party platforms that support app functionality.
Tumire, including its name, branding, layout, software, interface design, features, text, graphics, compilations, and all related intellectual property rights, is owned by or licensed to the app provider and is protected under applicable intellectual property laws. Except for the limited license expressly granted in these Terms, no right, title, or interest in Tumire is transferred to you.
You may not copy, modify, distribute, publicly display, create derivative works from, sell, lease, or otherwise exploit any part of the app except as expressly allowed by law or with prior written permission from the rights holder.
You agree to defend, indemnify, and hold harmless Tumire and its owners, operators, affiliates, licensors, contractors, and service providers from and against any claims, demands, actions, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising out of or related to: your use of the app; your content; your violation of these Terms; your breach of any applicable law or regulation; or your infringement or misappropriation of any third-party rights.
Tumire is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by applicable law, we disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and quiet enjoyment.
We do not warrant that the app will be error-free, uninterrupted, secure, accurate, compatible with every device, or free from harmful components, nor do we warrant that generated suggestions will meet your expectations or produce desired plant-care results.
Tumire may offer consumable virtual coins through Apple in-app purchases. Coins may be used to request new Plant Care Checks after free uses are exhausted. Free uses, when offered, may be limited, may be randomly assigned within the app experience, and may apply only to eligible analysis requests.
Coins are virtual items only. They have no cash value, are not redeemable for money, are not transferable, and do not constitute personal property. Coin balances may be displayed in the app, and coin use occurs only when an eligible analysis is successfully completed and a result is generated. Viewing history, editing reminders, deleting records, and similar local management features may remain free as described in the app.
Except where required by applicable law or by Apple platform rules, purchases are final and non-refundable. Consumable purchases generally are not restorable in the same way as non-consumable items, though purchase issues may be reviewed based on platform records and local verification data where applicable. Pricing, coin amounts, and product identifiers may change without notice to the extent permitted by law and platform policy.
You must be at least 17 years old, or the age of majority required to enter a binding agreement in your jurisdiction, whichever is higher, to use Tumire on your own behalf. By using the app, you represent and warrant that you meet the applicable age requirement and have the legal capacity to agree to these Terms.
If you are using the app on behalf of another person or entity, you represent that you are authorized to bind that person or entity to this agreement.
We may revise or update these Terms and Conditions at any time. Updated terms may be posted within the app, through an associated listing, or by other reasonable notice. Changes become effective when posted unless a later date is stated.
Your continued use of Tumire after the effective date of updated terms constitutes your acceptance of the revised agreement. If you do not agree to the updated terms, you must stop using the app.
You are responsible for the accuracy, legality, and appropriateness of the information and content you provide, including photos, notes, labels, and contextual details. You are also responsible for reviewing generated suggestions and deciding whether any action is safe and suitable for your plant and environment.
You are responsible for maintaining your device, notification settings, purchase controls, and any permissions required for features you choose to use. You should not rely on Tumire as a substitute for professional judgment where plant condition appears serious, unusual, or beyond general care observation.
Tumire is offered on an availability basis, and we do not guarantee that the app or any feature will always be accessible, timely, functional, or compatible with your device or operating system. Features may depend on third-party services, local device permissions, Apple infrastructure, internet connectivity, or software updates.
We reserve the right to modify, suspend, limit, or discontinue all or part of the service at any time, temporarily or permanently, with or without notice. We are not liable for any interruption, delay, loss of access, feature removal, or resulting consequences.
These Terms and Conditions are governed by the applicable laws that may validly apply to the operation and use of Tumire, without regard to conflict of laws principles to the extent such principles would require the application of another jurisdiction's laws. Any dispute arising from or relating to these Terms or the app will be handled in accordance with applicable law and the mandatory rights that may apply in your jurisdiction.
